In Michigan there are three basic ways to develop real estate - by land division, as a subdivision, or as a condominium. Development of real estate as a condominium lends itself to flexibility, privacy, day to day governance by the association, the potential for mixed uses, and creativity. The creation of a condominium project is a complicated matter. Our firm works with the developer to assist the developer and the engineer in addressing those issues that must be addressed to create a condominium under the Michigan Condominium Act.

Some representative issues include:

  1. Governmental approvals.
  2. Preliminary notices.
  3. Preliminary reservation agreements.
  4. Escrow agreement requirements.
  5. Title insurance issues.
  6. Drafting of master deed and condominium by-law.
  7. Development and review of the condominium subdivision plan with the engineer.
  8. Agreement for sale of condominium units.
  9. Brokerage agreements.
  10. Disclosure statements.
  11. Documentation of unit sales.
  12. Amendment of condominium documents.
  13. Enforcement of restrictions.
  14. Development of a budget and reserve requirements.
